Welcome to the official website of the William (WM) Mack and Emma Blackmon Family. These Terms of Use govern your access to and use of wmackandemmablackmonfamily.com, including its registration forms, online store, family archives, photo galleries, membership areas, and other related features and services collectively referred to as the “Site.”

The Site is operated by the William (WM) Mack and Emma Blackmon Family Executive Committee, referred to in these Terms as the “Executive Committee,” “we,” “us,” or “our.”

By accessing the Site, completing a registration, making a payment or donation, purchasing merchandise, submitting content, or using any Site feature, you acknowledge that you have read, understood, and agreed to these Terms of Use.

If you do not agree with these Terms, please discontinue your use of the Site.

1. Purpose of the Site

The Site is provided to:

  • Share Blackmon family history, news, announcements, and updates;

  • Provide information about family reunions, meetings, programs, and activities;

  • Process reunion registrations, family membership fees, donations, and merchandise purchases;

  • Preserve and share family photographs, videos, documents, stories, and historical records;

  • Administer scholarships, cemetery initiatives, legacy projects, and other approved family programs; and

  • Support communication and connection among members and descendants of the William Mack and Emma Blackmon family.

The Site is intended primarily for Blackmon family members, descendants, authorized guests, and individuals with a legitimate interest in the family’s activities or history.

2. Eligibility and User Responsibilities

You must be at least 18 years old to independently submit payments, place orders, or complete registrations through the Site. A parent or legal guardian must complete transactions involving a minor.

When using the Site, you agree to:

  • Provide accurate, complete, and current information;

  • Use only a payment method that you are authorized to use;

  • Maintain the confidentiality of passwords or access information provided to you;

  • Use the Site only for lawful and appropriate purposes;

  • Respect the privacy, dignity, and intellectual property of family members; and

  • Avoid conduct that could damage, disrupt, or interfere with the Site or its users.

You are responsible for correcting inaccurate information and notifying us if your contact information changes.

3. Payments and Transactions

The Site may accept payments for:

  • Family membership fees;

  • Reunion registration and related activities;

  • Merchandise and family-branded products;

  • Scholarship, cemetery, heritage, and legacy initiatives;

  • Donations to designated family funds; and

  • Other Executive Committee-approved programs or activities.

All prices and payments are stated in U.S. dollars unless otherwise indicated.

By submitting a payment, you represent that the payment information is accurate, that you are authorized to use the selected payment method, and that you authorize the applicable charge.

A transaction is not complete until the payment has been successfully processed. Please retain your confirmation email or receipt. If you do not receive confirmation within 48 hours, contact us.

We may correct pricing, description, availability, or clerical errors. If an error materially affects a completed transaction, we will contact the purchaser when reasonably possible.

4. Donations

Donations are voluntary contributions and are not payments for goods or services. Donations are generally non-refundable once processed, except in cases such as a duplicate charge, processing error, unauthorized transaction, or another circumstance required by law.

Unless and until the organization receives applicable recognition as a tax-exempt charitable organization, donations should not be assumed to be tax-deductible. Donors should consult a qualified tax professional concerning their individual circumstances.

We will make reasonable efforts to use designated donations for their stated purpose. If a specific purpose becomes unavailable, impractical, or fully funded, the Executive Committee may apply the funds to a closely related family purpose, consistent with applicable law and any governing family policies.

5. Family Membership Fees

Family membership fees support the organization’s ongoing administration, family communications, programs, planning, website, and approved family initiatives.

Family membership fees are not tied to attendance at a particular reunion or event and are non-refundable once processed, except in the event of a duplicate charge, payment-processing error, unauthorized transaction, or as otherwise required by law.

Payment of a family membership fee does not create an ownership interest in the organization or guarantee appointment, voting rights, benefits, merchandise, or admission to an event unless expressly stated.

6. Reunion Registration and Event Participation

Reunion registration is intended for Blackmon family members and their authorized guests. Registration may include admission to designated activities, meals, programs, merchandise, or other items specifically listed in the selected registration package.

Registration benefits are limited to what is expressly included in the package purchased. Travel, lodging, transportation, excursions, and other third-party expenses are not included unless specifically stated.

Participants are responsible for:

  • Providing accurate registration information;

  • Reviewing event schedules and communications;

  • Meeting all deadlines;

  • Obtaining their own transportation and accommodations;

  • Supervising children or dependents in their care; and

  • Following venue rules and reasonable instructions from event organizers.

We may refuse or cancel a registration when reasonably necessary because of nonpayment, inaccurate information, safety concerns, misconduct, capacity limitations, or a violation of these Terms.

Cancellation and refund eligibility are governed by our posted Refund Policy.

7. Event Changes, Postponements, and Cancellations

Event schedules, activities, speakers, meals, venues, accommodations, and other arrangements may change.

If a reunion or family event is postponed, substantially changed, or canceled because of weather, natural disaster, public health concerns, venue loss, government action, vendor failure, low participation, safety concerns, or another circumstance beyond our reasonable control, the Executive Committee will determine whether refunds, partial refunds, credits, rescheduling, or another reasonable remedy can be offered.

Any available remedy may depend on expenses already paid or contractually committed to venues, vendors, processors, or service providers.

The Executive Committee is not responsible for separately purchased airfare, lodging, rental vehicles, excursions, transportation, or other personal expenses.

8. Merchandise and Online Store Purchases

Merchandise may be produced and fulfilled by independent print-on-demand manufacturers, suppliers, carriers, and fulfillment partners, including Printful, Printify, Peaprint, or comparable providers.

Product images are provided for illustration. Colors, placement, dimensions, materials, and other details may vary slightly because of screen settings, manufacturing processes, available materials, or product updates.

Estimated production and delivery dates are not guaranteed. We are not responsible for delays caused by carriers, weather, customs, incorrect addresses, unavailable materials, or other circumstances outside our reasonable control.

Customers are responsible for reviewing product descriptions, sizing information, personalization fields, shipping addresses, and order details before submitting an order.

Merchandise refund, replacement, cancellation, and damage-reporting requirements are governed by our posted Refund Policy.

9. Third-Party Services and Links

The Site may contain links to payment processors, hotels, travel providers, social media platforms, photo-storage services, merchandise suppliers, or other third-party websites and services.

We do not control and are not responsible for the availability, security, content, privacy practices, pricing, policies, products, or actions of third parties. Your use of a third-party service is governed by that provider’s own terms and policies.

A link or reference to a third party does not necessarily constitute an endorsement.

10. Family Photographs, Videos, Stories, and Historical Materials

The Site may contain photographs, videos, documents, family trees, obituaries, stories, oral histories, land records, wills, genealogy materials, and other family or historical content.

Some historical information may be incomplete, disputed, based on family recollection, or subject to later correction. We do not guarantee the completeness or accuracy of all genealogical or historical material.

Unless otherwise indicated, materials are provided for personal, family, educational, and historical use. They may not be sold, commercially exploited, misrepresented, or republished in a manner that violates another person’s privacy, intellectual property, or publicity rights.

If you believe a photograph, name, historical statement, or other item should be corrected, credited, restricted, or removed, please contact us with sufficient details to identify the material.

11. Content Submitted by Family Members

By submitting photographs, videos, stories, documents, captions, genealogy information, testimonials, or other material, you confirm that:

  • You own the material or have permission to submit it;

  • Your submission does not knowingly violate another person’s rights;

  • The information you provide is accurate to the best of your knowledge; and

  • You have obtained any reasonably necessary permission from identifiable individuals.

You retain ownership of your original material. However, by submitting it, you grant the Executive Committee a nonexclusive, royalty-free license to store, reproduce, organize, edit for formatting or clarity, archive, and display the material for family, historical, educational, reunion, website, and organizational purposes.

We may decline, restrict, edit, archive, or remove submitted material when reasonably necessary. Submission does not guarantee publication.

You may contact us to request future removal or restricted display. We will consider such requests reasonably, although removal may not be possible from previously printed materials, completed videos, backups, or historical records already distributed.

12. Password-Protected and Family-Only Areas

Certain archives, galleries, documents, meetings, or other Site areas may be password-protected or restricted to family members and authorized guests.

Access credentials are intended only for the person or group to whom they were provided. You may not publicly post, sell, distribute, or misuse passwords, private links, meeting credentials, or restricted family content.

Password protection reduces public access but cannot guarantee absolute confidentiality. Users should exercise good judgment when uploading, viewing, downloading, or sharing family materials.

We may revoke or restrict access when credentials are misused or when necessary to protect family privacy or Site security.

13. Intellectual Property

Unless otherwise stated, the Site’s original design, written content, family branding, logos, reunion graphics, merchandise designs, compilations, and other materials created for the William Mack and Emma Blackmon Family are owned or controlled by the Executive Committee or used with permission.

You may view, download, or print reasonable portions of the Site for personal, noncommercial family use.

You may not reproduce, sell, license, alter, distribute, publish, commercially exploit, or use our branding or original materials without prior written permission.

Ownership of independently submitted family photographs, documents, and stories remains with their respective owners, subject to any permission granted for family use.

14. Prohibited Uses

You may not use the Site to:

  • Commit fraud or submit unauthorized payments;

  • Impersonate another person;

  • Harass, threaten, exploit, or unlawfully discriminate against another person;

  • Collect personal information for unauthorized solicitation or commercial purposes;

  • Upload viruses, malicious code, spam, or disruptive content;

  • Attempt to gain unauthorized access to accounts, archives, administrative systems, or payment information;

  • Scrape, copy, or systematically extract Site content without permission;

  • Publicly distribute restricted family information or passwords;

  • Infringe copyrights, privacy rights, publicity rights, or other legal rights;

  • Resell family merchandise or content without authorization; or

  • Use the Site in violation of applicable law.

We may restrict or terminate access to the Site when we reasonably believe these Terms have been violated.

15. Privacy

Our collection and use of personal information are governed by our posted Privacy Policy, which is incorporated into these Terms by reference.

Payment card information is generally processed by third-party payment processors and is not directly stored by the Executive Committee.

16. Website Availability and Disclaimer

We strive to keep the Site accurate, secure, and available. However, the Site and its content are provided on an “as available” basis.

To the extent permitted by law, we do not guarantee that:

  • The Site will always be available, uninterrupted, or error-free;

  • Every historical or genealogical statement will be complete or accurate;

  • Third-party links or services will remain available;

  • Products will always remain in stock; or

  • Archived digital material will never be lost, damaged, or inaccessible.

We may update, suspend, restrict, or discontinue any portion of the Site when reasonably necessary.

Nothing on the Site constitutes legal, tax, financial, medical, or professional advice.

17. Limitation of Liability

To the fullest extent permitted by law, the Executive Committee and its officers, committee members, volunteers, and authorized representatives will not be liable for indirect, incidental, special, punitive, or consequential damages arising from:

  • Use of or inability to access the Site;

  • Reliance on Site content;

  • Third-party websites or services;

  • Event changes or cancellations;

  • Shipping or fulfillment delays;

  • Unauthorized access outside our reasonable control; or

  • Loss of submitted or stored digital materials.

Nothing in these Terms excludes liability that cannot legally be excluded or limited.

Participation in family events and voluntary activities is at the participant’s own reasonable risk. Participants remain responsible for their personal property, travel arrangements, health needs, children, and invited guests.

18. Refund Policy

Our current Refund Policy governs donations, family membership fees, reunion registrations, merchandise purchases, cancellations, refunds, exchanges, replacements, and transaction-related disputes.

If these Terms conflict with the Refund Policy regarding a refund, cancellation, or merchandise claim, the Refund Policy will control for that issue.

19. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law principles.

Before beginning formal legal proceedings, the parties agree to make a good-faith effort to resolve disputes through written communication and informal discussion.

If the matter cannot be resolved informally, the parties may pursue mediation, arbitration, or another remedy permitted by applicable law in Mecklenburg County, North Carolina.

Nothing in this section prevents either party from seeking relief in small claims court or requesting immediate injunctive relief when legally appropriate.

20. Changes to These Terms

We may revise these Terms as the Site, family programs, laws, vendors, or organizational needs change.

Revisions become effective when posted unless another effective date is stated. The “Last Updated” date at the top of this page will identify the latest revision.

Your continued use of the Site after revised Terms are posted constitutes acceptance of those revisions.

21. Severability and Entire Agreement

If any portion of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue in effect.

These Terms, together with the Privacy Policy, Refund Policy, posted event rules, registration disclosures, and applicable checkout terms, constitute the agreement governing use of the Site.
