1. Acceptance of Terms
By registering for the Blackmon Family Reunion, paying a Family Membership Fee, making a donation, or purchasing merchandise through the Blackmon Family Store, you (“participant,” “customer,” “you,” or “your”) agree to be bound by this Refund Policy and the accompanying Terms and Conditions in their entirety. If you do not agree to these terms, please do not complete your registration, submit payment, make a donation, or place an order.
This policy applies to all transactions processed through the Blackmon Family Reunion registration portal and the Blackmon Family Store, including but not limited to: reunion registration fees, Family Membership Fees, charitable donations, and merchandise purchases. These transactions are administered by the William (WM) Mack and Emma Blackmon Family Executive Committee (“Executive Committee,” “we,” “us,” or “our”).
2. Definitions
- Reunion Event: The Blackmon Family Reunion, including all scheduled activities, meals, programs, and gatherings associated with the event weekend.
- Registration Fees: Fees paid to register one or more family members for attendance at the Reunion Event, including general registration, children’s registration, or any tiered registration packages.
- Family Membership Fee: The annual or recurring fee assessed to family members for membership in the Blackmon Family organization.
- Donations: Voluntary financial contributions made to the Blackmon Family Cemetery Fund, Scholarship Fund, or any other designated fund managed by the Executive Committee.
- Merchandise / Store: Made-to-order products sold through the Blackmon Family Store and produced by third-party Production Partners. The Store does not currently offer personalized, customized, or specialty merchandise.
- Production Partners: Third-party production and fulfillment providers used by the Store, currently including Printful, Printify, and Peaprint.
- Local Blackmon Family Committees: The designated regional or local planning committees responsible for coordinating the Reunion Event.
3. Payments
3.1 Accepted Payment Methods
The Executive Committee accepts payments through the methods listed on the registration portal and Store checkout at the time of transaction. All payments must be made in U.S. dollars. The Executive Committee reserves the right to update accepted payment methods at any time.
3.2 Payment Authorization
By submitting a payment, you represent and warrant that: (a) you are authorized to use the payment method provided; (b) the payment information you provide is accurate and complete; and (c) you authorize the Executive Committee and its payment processors to charge the total amount due at checkout.
3.3 Payment Categories
- Reunion registration fees (individual, family, or group)
- Family Membership fees
- Cemetery upkeep donations
- Scholarship fund donations
- Blackmon Family Store merchandise (apparel, drinkware, keychains, and other family-branded items)
3.4 Confirmation
Upon successful payment or order, you will receive a confirmation. Please retain this confirmation for your records. If you do not receive a confirmation within 48 hours, contact the Executive Committee at blackmonexecutivecommittee@gmail.com.
4. Refund Policy
4.1 Reunion Registration & Event Fees
The following refund schedule applies to all reunion registration and event-related fees (excluding Family Membership Fees, see Section 4.2):
- Full Refund: issued if cancellation notice is submitted to the Local Blackmon Family Committees at least 45 days prior to the Reunion Event.
- 25% Refund: issued if cancellation notice is submitted between 45 and 30 days prior to the Reunion Event.
- No Refund: issued for cancellations submitted fewer than 30 days prior to the Reunion Event.
To initiate a cancellation and request a refund, participants must provide written notice to the Local Blackmon Family Committees. The date written notice is received will serve as the official cancellation date for refund eligibility purposes.
4.2 Family Membership Fees
Family Membership Fees are non-refundable under all circumstances. These fees support the ongoing operations and administration of the Blackmon Family organization and are not tied to attendance at any specific Reunion Event
4.3 Donations
All donations made to the Blackmon Family Cemetery Fund, Scholarship Fund, or any other designated fund are voluntary and non-refundable. Donations are used to support the stated purpose of each fund and are not considered payment for goods or services.
4.2 Family Store Merchandise (Made-to-Order)
4.4.1 Made-to-Order Merchandise
Most merchandise is produced specifically after an order is submitted. Because production begins quickly and each item is created for the order, general returns or exchanges are not accepted for:
- Change of mind or buyer’s remorse.
- An incorrect size, color, style, quantity, or design option selected by the customer.
- A preference for a different fit, shade, material feel, or placement not caused by a production defect.
- Minor variations normal for printing, embroidery, fabric, screens, lighting, or manufacturing.
- A delay that remains within the estimated production or carrier-delivery window.
4.4.2 No Personalized or Specialty Merchandise
At this time, the Store does not offer personalized, customized, one-of-a-kind, or specialty merchandise. Products are sold only in the designs, wording, colors, sizes, and options shown on the product page. Notes entered during checkout do not create a customization request or change the product ordered.
4.4.3 Damaged, Defective, Misprinted, or Incorrect Items
If an item arrives damaged, defective, materially misprinted, or different from what was ordered due to a fulfillment error, contact us within 30 calendar days after delivery with:
- Your name, email address, and order number.
- A description of the problem.
- Clear photographs showing the entire item and the specific issue.
- A photograph of the shipping label and outer packaging when transit damage or an incorrect shipment may be involved.
After review — and, when necessary, submission to the applicable Production Partner — we may provide a replacement, reprint, store credit, partial refund, or full refund, depending on the nature of the issue, product availability, and the Production Partner’s determination.
4.4.4 Returns of Problem Items
Do not mail an item back to the Executive Committee or any Production Partner unless we first provide written return instructions. Many approved quality claims do not require a physical return.
4.4.5 Size and Fit
Customers are responsible for reviewing the product description and size chart before ordering. We do not provide returns, refunds, or exchanges because an item does not fit as expected when the size ordered was produced and shipped correctly. If the item received is labeled or measured as a different size than ordered, report the issue within 30 days of delivery.
4.4.6 Color, Print, Embroidery, and Material Variations
Colors may appear differently across screens. Printed and embroidered products may show small variations in color, placement, texture, grain, or finish; these are not defects. A claim may be approved when the variation is substantial and results from a confirmed manufacturing or fulfillment error.
4.4.7 Cancellation or Order Changes
Submit cancellation or change requests immediately after ordering. Once an order has entered production, it normally cannot be canceled or changed, including changes to shipping address, size, color, design, or quantity. If we are able to stop the order before production, we may cancel it and refund the eligible amount to the original payment method.
4.4.8 Lost, Delayed, or Missing Shipments
Production and delivery dates are estimates, not guarantees. Items in one order may ship separately from different facilities.
- If tracking shows no delivery and the package appears lost, contact us no later than 30 days after the estimated delivery date.
- If tracking shows delivered but the package cannot be located, first check with household members, neighbors, the carrier, and the leasing office or other secure delivery locations.
- Carrier delays, weather, peak-season volume, customs, and address problems may extend delivery times and are outside our reasonable control.
- A replacement or refund for a lost shipment is subject to carrier and Production Partner review.
4.4.9 Incorrect or Incomplete Address
Customers are responsible for providing a complete and accurate delivery address. If a package is returned, undeliverable, or lost because of a customer-supplied error, the customer may be responsible for reshipment and any new production costs; original shipping charges are not refundable.
4.4.10 Refund Processing
Approved refunds are issued to the original payment method whenever possible. Processing time depends on the payment provider and financial institution. Original shipping charges are generally nonrefundable once production or shipment has begun, unless the refund results from our error, a confirmed fulfillment error, or applicable law requires otherwise.
4.4.11 In-Person and Reunion Purchases
Merchandise purchased in person should be inspected before leaving the sales area. In-person sales are final except for a concealed manufacturing defect, material printing error, or incorrect item supplied by us. A qualifying issue must be reported within 30 days of purchase, with proof of purchase and clear photographs when requested.
4.4.12 How to Request Help
Email blackmonexecutivecommittee@gmail.com with the subject line “Order Issue – [Order Number].” Include the information and photographs described above. Please do not return merchandise without written authorization.
4.5 Third-Party Services
This policy applies only to fees and purchases made directly through the Blackmon Family registration portal and Store. Refunds for hotel accommodations, car rentals, travel, excursions, or other third-party services are governed solely by the policies of those service providers. The Executive Committee has no authority to issue refunds on behalf of third-party vendors and assumes no liability for third-party cancellation or refund decisions.
5. Event Changes & Cancellations
The Executive Committee reserves the right to modify event schedules, activities, venues, or other logistics as necessary. If the Reunion Event is fully canceled due to circumstances beyond the Executive Committee’s reasonable control (including natural disasters, public health emergencies, or venue loss), the Executive Committee will make reasonable efforts to issue refunds or credits. The Executive Committee is not liable for travel, lodging, or other costs incurred by participants in connection with such cancellations.
6. Registration & Eligibility
Registration for the Blackmon Family Reunion is intended for members of the Blackmon family and their authorized guests. The Executive Committee reserves the right to refuse or cancel registration at its discretion. Participants are responsible for ensuring all registration information submitted is accurate and complete.
7. Family Store Terms and Conditions
7.1 Store Operator
The Store is operated by Jay Black on behalf of the William Mack and Emma Blackmon Executive Committee for the benefit of Blackmon family activities and related purposes.
7.2 Eligibility and Accurate Information
You must be legally capable of entering into a purchase agreement, or use the Store with the involvement of a parent or legal guardian. You agree to provide accurate billing, shipping, contact, and payment information.
7.3 Products and Availability
We make reasonable efforts to describe and display products accurately. Product colors, scale, placement, materials, and appearance may vary slightly from screen images and mockups. Products, sizes, colors, designs, and prices may change, be limited, replaced, or discontinued without notice.
7.4 No Personalized or Specialty Merchandise
Only the options displayed and selectable on the applicable product page are available. Customer notes, emails, or comments do not modify the product or create an obligation to customize an order.
7.5 Orders and Order Acceptance
An order confirmation acknowledges receipt; it does not guarantee acceptance or fulfillment. We may cancel or refuse an order due to product unavailability, suspected fraud, pricing or listing errors, payment problems, technical issues, shipping restrictions, or other reasonable business concerns. If we cancel an order after payment, the amount charged for the canceled portion will be refunded.
7.6 Pricing, Taxes, and Payment
Prices are shown in U.S. dollars unless stated otherwise. Applicable taxes, shipping, and other charges are displayed at checkout. Prices and promotions may change without notice and are not retroactive.
7.7 Production Partners and Fulfillment
We use third-party Production Partners, which may include Printful, Printify, Peaprint, and their printing, manufacturing, and carrier networks. By ordering, you authorize us to share the information reasonably necessary to produce, fulfill, ship, track, and support your order.
7.8 Shipping and Delivery
Production and shipping estimates are provided for convenience and are not guaranteed delivery dates. Items in one order may arrive in separate packages on different dates. You are responsible for providing a secure, deliverable address and monitoring tracking information.
7.9 Promotions and Discount Codes
Promotions, discount codes, bundles, and limited-time offers are subject to the terms displayed with the offer. They may not be combined unless expressly stated, have no cash value, and may be changed or withdrawn before an order is completed.
8. Privacy & Data Use
Information collected during registration, donation, membership, or a Store order (including names, contact information, and payment details) is used solely to administer the Reunion Event, Blackmon Family communications, and Store orders. We do not sell or share personal information with third parties except as required to process payments and fulfill orders through authorized payment processors and Production Partners. Payment card information is processed by third-party processors and is not stored by the Executive Committee.
9. Conduct & Liability
All participants are expected to conduct themselves in a respectful and lawful manner throughout the Reunion Event. The Executive Committee reserves the right to remove any participant whose behavior is deemed disruptive, harmful, or inappropriate, without refund.
The Executive Committee, its officers, committee members, and volunteers are not liable for personal injury, loss, theft, or damage to personal property occurring during Reunion Event activities. Participation in all Reunion Event activities is voluntary and at each participant’s own risk.
10. Intellectual Property
All Blackmon Family branding, logos, designs, Store artwork, website content, photographs, and other original material are owned by or licensed to Jay Black and are protected by applicable intellectual-property laws. You may purchase and use merchandise for personal, noncommercial purposes. You may not copy, reproduce, sell, modify, upload, distribute, or commercially use Store artwork or site content without prior written permission. Unauthorized reproduction, distribution, or use of any family branding or imagery is prohibited.
11. Prohibited Use
You agree not to:
- Use the site or Store for unlawful, fraudulent, abusive, or misleading purposes.
- Attempt to gain unauthorized access to the site, accounts, payment systems, or connected services.
- Interfere with site security, functionality, or another person’s use of the site.
- Use automated tools to scrape, copy, or exploit site content without permission.
- Submit false claims, chargebacks, photographs, or information regarding an order.
- Resell merchandise in a way that falsely suggests authorization or endorsement by the Executive Committee.
12. Disclaimer of Warranties
To the fullest extent permitted by law, the site, Store, and merchandise are provided on an “as available” and “as is” basis, subject to the express remedies stated in Section 4. We do not guarantee uninterrupted site access, exact color matching across screens and materials, or delivery by a specific date. Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.
13. Limitation of Liability
To the fullest extent permitted by law, the Executive Committee and its volunteers, officers, representatives, and service providers will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the site, a delayed shipment, a merchandise purchase, or participation in the Reunion Event. Any direct liability relating to a merchandise order will not exceed the amount paid for the affected item, except where applicable law does not permit this limitation.
14. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless the Executive Committee and its authorized representatives from claims, losses, or expenses arising from your unlawful use of the site or Store, violation of these Terms, or infringement of another person’s rights.
15. Amendments
The Executive Committee reserves the right to amend this Refund Policy and Terms and Conditions at any time. Updated terms will be posted on the Blackmon Family website with a revised effective date and are effective upon posting. The version in effect when a registration, donation, membership payment, or order is placed will generally govern that transaction, except where a later change is required by law. Participants and customers are encouraged to review these terms periodically.
16. Severability and Waiver
If any provision of this policy is found unenforceable, the remaining provisions will remain in effect. A failure to enforce a provision on one occasion is not a waiver of the right to enforce it later.
17. Governing Law and Dispute Resolution
This Refund Policy and Terms and Conditions are governed by the laws of the State of North Carolina, without regard to conflict-of-law principles. Before filing a formal claim, you agree to contact us and allow a reasonable opportunity to resolve the matter informally. If resolution cannot be reached informally, disputes shall be submitted to binding arbitration or mediation in Mecklenburg County, North Carolina, subject to applicable consumer-protection law.
